Terms of Service

Welcome to 9frame. These Terms of Service ("Terms") are a legal agreement between you and the operator of 9frame ("9frame", "we", "us", or "our") and govern your access to and use of the 9frame website at 9frame.ai and the related AI photo studio service (together, the "Service"). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are

9frame is an online AI photo studio. You upload a few of your own selfies, and our Service generates AI-created editorial and studio-style photos of you across a range of visual "worlds" and styles.

9frame is operated by an individual entrepreneur registered in Ukraine (Ukrainian ФОП). The operator's full legal name and registered address are available on request at hello@9frame.ai. You can reach us at hello@9frame.ai or on Telegram at t.me/nineframe_support_bot.

2. Eligibility and Accounts

• You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older.
• You are responsible for keeping your account login details secure and for all activity that happens under your account.
• You agree to provide accurate information and to keep it up to date.
• We may refuse, suspend, or terminate accounts at our discretion, including where we reasonably believe these Terms have been violated.

3. The Service and How It Works

When you use 9frame, you upload photographs of your face ("selfies"), and our Service processes them to produce AI-generated images. To generate results, your uploaded photos are sent to third-party AI model providers that perform the image generation on our behalf (see our Privacy Policy for details). Generated images and your uploads are stored using cloud storage infrastructure (Cloudflare R2).

AI image generation is inherently probabilistic. We do not guarantee that any particular result will be photo-accurate, flattering, free of visual artifacts, or suitable for a specific purpose. Results vary depending on the selfies you provide.

4. Plans, Credits, and Free Trial

• New users receive 3 free trial photos to try the Service.
• We offer paid monthly subscription plans in US dollars: Starter ($15/month, 45 photos), Creator ($29/month, 100 photos), and Pro ($59/month, 270 photos). Current plans and prices are shown on our pricing page and may change over time.
• Each plan includes a monthly allowance of photo credits. Credits reset at the start of each billing period. Unused credits do not roll over or accumulate.
• A "photo" is counted, and a credit is consumed, when the Service generates or you download an image on your behalf, whether or not you choose to keep it.
• Credits have no cash value and are non-transferable, non-reloadable, and non-redeemable for cash. Any unused credits are forfeited when you cancel or when your account is closed.

5. Upgrades, Downgrades, and Cancellation

• Upgrade: You may upgrade your plan at any time. Upgrades take effect immediately and are prorated for the remainder of the current billing period. Your credit allowance is refreshed to the new plan's allowance.
• Downgrade: You may downgrade your plan at any time. Downgrades take effect at the end of your current billing period, and the lower allowance applies from the next period.
• Cancellation: You may cancel at any time. After cancellation, your subscription does not renew, and you keep access to your paid plan and remaining monthly credits until the end of the period you have already paid for. We do not provide partial refunds for the unused part of a billing period except as described in our Refund and Cancellation Policy.

6. Payments and Merchant of Record

All payments for the Service are processed by our authorized payment provider (acting as our Merchant of Record).

• When you purchase a subscription, our payment provider is the merchant that sells the subscription to you. The payment provider handles checkout, billing, renewals, invoices, and the calculation and collection of any applicable sales tax or VAT.
• Your purchase is also subject to our payment provider's buyer terms, presented to you at checkout.
• 9frame does not collect, store, or have access to your full payment card details. Card and payment data are handled by our payment provider.
• Refunds are processed by our payment provider in line with our Refund and Cancellation Policy and our payment provider's buyer terms.

By completing a purchase, you authorize our payment provider to charge your chosen payment method on a recurring basis for your subscription until you cancel.

7. Acceptable Use

9frame is a personal AI photo studio: it generates images of you, from selfies of yourself. You represent and warrant that every photo you upload is of yourself, or of a person who has given you their explicit, informed consent to upload their photo and generate AI images of them. 9frame is not a face-swapping or "deepfake" tool: you may only generate your own consented likeness, never a depiction of someone you are not authorized to portray.

You agree that you will not use the Service to create, upload, or generate content that:

• Uses photographs of anyone other than yourself, unless that person has given you their explicit, informed consent to upload and process their image.
• Uses the face or likeness of any public figure, celebrity, politician, or other identifiable person you are not authorized to depict.
• Is sexual or pornographic, or that sexualizes real people without consent, including sexual "deepfakes".
• Depicts, involves, or in any way relates to minors in a sexual context (child sexual abuse material is strictly prohibited and will be reported to the appropriate authorities).
• Impersonates another person, or is intended to deceive, defraud, defame, harass, threaten, or harm others, including "deepfake" content intended to mislead.
• Is illegal, promotes illegal activity, or infringes the intellectual property, privacy, or other rights of any person.
• Violates the Acceptable Use Policy of our payment processor or hosting providers, or any applicable law.
• Attempts to interfere with, disrupt, reverse engineer, scrape, or gain unauthorized access to the Service or its infrastructure.

We use automated and manual moderation on both uploaded selfies and generated results, and we may block, remove, or refuse any content. You are solely responsible for the selfies you upload and for confirming you have the right to use them. We may suspend or terminate accounts, remove content, and refuse service for any suspected violation of this section, without refund.

8. Your Content and Ownership

• Your uploads. You keep all rights you already have in the selfies you upload. You grant 9frame a limited, non-exclusive license to store and process those selfies solely to operate and provide the Service to you (including sending them to our AI model providers to generate results).
• Your generated images. As between you and 9frame, you own and may keep the AI-generated images you create, and you may use them for personal and commercial purposes, subject to these Terms (including the Acceptable Use section) and to any licensing terms of the third-party AI models used to generate them.
• Because AI models are trained on large datasets and generate outputs probabilistically, we cannot guarantee that a given output is unique, or that it can be registered or protected as your own original work. You are responsible for how you use generated images.

9. License to Use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Service. You may not resell, sublicense, or provide the Service to third parties, or use it to build a competing product.

10. Intellectual Property

The Service itself, including the 9frame name, branding, website, and software, is owned by 9frame or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers ownership of the Service to you.

11. Service Availability and Changes

We aim to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis. We may modify, suspend, add, or discontinue features, plans, or the Service as a whole, and we may set or change technical limits. We will try to give reasonable notice of material changes that negatively affect paying users.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated images will meet your expectations.

13. Limitation of Liability

To the maximum extent permitted by law, 9frame and its operator will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid to us (through our payment provider) in the three months before the event giving rise to the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Indemnity

You agree to indemnify and hold harmless 9frame and its operator from claims, damages, and reasonable costs arising out of your misuse of the Service, your violation of these Terms, or your uploading of images you did not have the right to use.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or the Acceptable Use section, or where required by law. On termination, your right to use the Service ends, and we will handle any remaining data as described in our Privacy Policy.

16. Governing Law and Disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. You and 9frame will try to resolve any dispute informally first by contacting us at hello@9frame.ai. This section does not remove any mandatory consumer-protection rights you have under the law of your country of residence. Note that payment, billing, and refund matters may also be governed by our payment provider's buyer terms.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
